I, as a pre-requisite to receiving HeartMath coaching sessions from a HeartMath® Certified Coach or Mentor Janice Bird (“Coach/Mentor”), understand and agree with the following:
“HeartMath has developed highly successful programs for self-improvement in mental, emotional and physical balance. HeartMath technology and materials are not intended to replace treatments for medical or psychological conditions by licensed physicians, psychologists or other health care professionals.”
I further agree that:
All information contained in the HeartMath program for clients is intended for my general knowledge, education and entertainment only and is not a substitute for medical advice or treatment for specific medical conditions. I understand and agree that I should seek prompt medical care for any specific health issues and consult my physician before starting a new fitness regimen, herbal therapy, or other self-directed treatment.
I understand that the Coach/Mentor:
a. Makes no representations or warranties with respect to any information contained in the HeartMath program or discussed in the HeartMath sessions.
b. Will not be liable for any direct, indirect, consequential, special, exemplary, or other damage arising from use of the program and/or attendance at the sessions.
c. Shall have no liability with respect to delivery of the HeartMath program for consequential, exemplary, special, incidental, or punitive damages even if she has been advised of the possibility of such damages.
In any event, the liability of Coach/Mentor for any reason and upon any cause of action shall be limited to the amount actually paid by me for HeartMath sessions. This limitation applies to all causes of action in the aggregate, including, without limitation, to breach of contract, breach of warranty, negligence,strict liability, misrepresentations, and other torts.
